[The landlord’s representative/s] provided a copy of the final inspection report with photographs, and a list detailing the more substantial chattels left behind (beds, kitchenware, dining table, etc).
On the last day of the tenancy Ms Macy stated that she didn’t intend to take all of her belongings with her. [The landlord’s representative/s] attempted to get confirmation in writing from Ms Macy that [The landlord/s] could dispose of all the remaining belongings, but she has been unable to contact Ms Macy since the end of the tenancy.
Based on [The landlord’s representative/s]’ oral evidence and photographs, I am satisfied that: a. The landlord has made all reasonable efforts to contact the tenant. b. The tenant does not intend to retrieve any of the remaining belongings. c. The age and condition of the belongings is such that they have no realisable market value beyond the cost of storage and sale.
[The landlord’s representative/s] confirmed that there are no personal documents at the premises.
The landlord may dispose of all remaining belongings as the landlord sees fit.
The landlord has been successful in this application and I must also award the landlord the filing fee of $20.44.
The landlord sought name suppression. Name suppression is granted on the grounds that the landlord has substantially succeeded in the proceedings.
