Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the tenant and landlord’s name and identifying details.
BY CONSENT
- The tenant withdraws her application and in return, in full and final settlement of the matters presently before the Tribunal, by 4pm on Friday 16 February 2024: i. [The landlord/s] will lodge the sum of $1,280 as paid to them by [The tenant/s] at the Bond Centre. ii. [The landlord/s] will pay [The tenant/s] $1,500.
Reasons
- A dispute has arisen between the tenant and landlord.
- The Tribunal heard the claims but at the end of the hearing both parties agreed on a settlement of the dispute and the tenant’s application is therefore withdrawn. The parties are aware that the settlement is in full and final settlement of the matters currently before the Tribunal being: a. Failure to lodge a bond of $1,280 – Exemplary damages b. Failure to maintain in relation to flooding/drainage and a fence – Exemplary damages and compensation c. Breach of quiet enjoyment in relation to an incident taking place when the landlord came to the property the day after the tenant gave the landlord a 14 day notice - Exemplary damages d. Retaliatory notice - Exemplary damages
- To settle the dispute, the tenant withdraws her application and in return in full and final settlement of the tenant’s claims, by 4pm on Friday 16 February 2024: i. - The parties both requested name suppression (s 95A, Residential Tenancies Act 1986). The parties have agreed to settle the dispute effectively by a mediated resolution. This could have taken place at a confidential mediation, but it was expedient to deal with the settlement following a full hearing of the issues today. I therefore grant both parties name suppression.
