The applicant has applied for possession of the property under section 65(1) of the Residential Tenancies Act 1986. That section provides for the Tribunal to make an order to evict squatters. (1) Where, on the application of any person entitled to possession of any residential premises, the Tribunal is satisfied that any other person is in possession of the premises as a squatter or trespasser, or otherwise than pursuant to any right of occupation granted to that person by any person having lawful authority to grant that right to that other person, the Tribunal shall make a possession order granting possession of the premises to the applicant. (3) To avoid doubt, the Tribunal has jurisdiction under this section even though the premises are not subject to a tenancy agreement.

The applicant owns [Tenancy address suppressed]. She purchased the property and allowed the respondent to occupy it free of rent. The parties are related. The applicant is concerned about the state of the property. The applicant requested the respondent to provide access to clean up the property, have it tested for contamination and have it checked for Healthy Homes Standards.

On 1 December 2023 the applicant’s solicitor wrote to the respondent requesting access and to reach agreement about a fair market rent for the respondent’s ongoing occupation of the property. The letter informed the respondent that the failure to respond to the letter by 15 December 2023 would lead to a trespass notice and an application to the Tenancy Tribunal for eviction.

The respondent did not respond to the letter. A Trespass Notice was issued and an application to the Tribunal was made on 18 December. The respondent and her family remain at the property. I am satisfied that she is a squatter.

The order is made to grant possession to the applicant.
