Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the tenant and landlord’s name and identifying details.
- [The landlord/s] must pay [The tenant/s] $5,000.00 in full and final settlement of all the claims between the parties arising from this tenancy. The $5,000.00 will be paid in two instalments: a. $2,500.00 on or before 6pm on Wednesday 22 May 2024; and b. $2,500.00 on or before 6pm on Wednesday 2 June May 2024.
- [The tenant/s], or her representative, [The tenant's representative], must provide the banking details for the payments to [The landlord/s] by 3pm on Monday 20 May 2024.
- If either of the above instalments are not paid within 2 working days of their due date the whole of the remaining debt will be become payable immediately and enforceable as a debt.
Reasons
- Both parties attended the hearing. The landlord had a support person. The tenant had a representative. The landlord had assistance from an appointed interpreter.
- Both the landlord and tenant have substantial claims against each other. These are particularised in my order dated 6 March 2024.
- I heard submissions and evidence in relation to the majority of the tenant’s claims. During the course of the hearing the parties were able to independently reach an agreement. The agreement reached settles all claims arising out of the tenancy between the parties. This agreement is set out in my order.
- The Tribunal commends the parties for settling this multi-faceted dispute.
- Both parties sought name suppression. I have awarded suppression to both parties as they have reached an agreement which could have been achieved at a confidential mediation. It is in the public interest that parties can reach an agreement (s95A(4), Residential Tenancies Act 1986).
