The landlord’s application is dismissed.

Reasons

Both parties attended the hearing by telephone.
The landlord applied to terminate the tenancy because the tenant’s rent was 21 days in arrears at the date of the application. See section 55(1)(a) Residential Tenancies Act 1986 (“RTA”).
Section 55(1)(a) RTA provides that the Tribunal shall make an order terminating the tenancy if the rent was 21 days in arrears at the date on which the landlord’s application was filed.
However, section 55(2) RTA provides that the Tribunal may refuse to make an order terminating the tenancy if the arrears have been paid and it is unlikely that the tenant will fall into arrears again.
Before the hearing, the tenant arranged for the arrears to be paid and has put in place arrangements so that the rent is paid by direct debit.
I am satisfied that it is unlikely that the tenant will fall behind in her rent. It is appropriate to dismiss the landlord’s application. See section 55(2) RTA.
As discussed at the hearing, the tenant needs to be aware that she came close to having her tenancy ended and that she needs to ensure that her rent payments do not fall behind again.
As the landlord’s application has been dismissed, it is appropriate to suppress the tenant’s name.
