Reasons

Neither party attended the hearing.
Telephone calls were made to both parties on the numbers provided at the allocated hearing time. Calls to the landlord just cut off and all calls to the tenants went to voicemail.
I am satisfied that the parties had received proper notice of the hearing time, date and place and chose not to attend.
On 4 March 2024, the Tribunal adjourned the hearing as neither party attended the hearing. It ordered the landlord to “file a rent summary with Tenancy Services in the format set out in the Tenancy Services website and copies of water rates invoices within 5 working days of the date of this order” and to “confirm a contact telephone number with Tenancy Services”. The landlord has not complied with these orders.
On the morning of 28 March 2024 I gave the landlord until 1pm to comply with the Tribunal’s 4 March 2024 Order and informed him if he failed to do so and did not attend the hearing I would dismiss the application. He did not.
It is a waste of the Tribunal’s time for landlords to make applications without providing any evidence to support their claims, not making themselves available for hearings set down, not ensuring that the Tribunal has up to date contact details for them and failing to follow orders that would allow both parties to have a fair hearing on the matters raised by the landlord.
Mr Kumar has had reasonable time to produce the requested evidence to support his claims and he has repeatedly failed to provide that evidence. He has failed to appear at two hearings and does not give the Tribunal the courtesy of making contact to explain why he is failing to attend and/or why he is failing to produce the requested evidence.
I dismiss the landlord’s claims accordingly.
