[The tenant/s] must pay Aspire Property Services Limited as agent for Prasad, Shailesh $975.00 immediately, being rent arrears to 28 March 2024.

Reasons

Both parties attended the hearing. The landlord was represented by Mr Srhoj and Ms Harrall. [the tenant] appeared on behalf of herself and [tenant 2].
This is a long standing tenancy dating back to 18 June 2021. However due to recent rent arrears the landlord has applied to terminate the tenancy.
The landlord produced rent records showing current arrears at $1,950. The landlord has served four 14 day notices, on 20 December 2023, 7 February 2024, 14 February 2024 and 19 February 2024.
At the hearing [the tenant] explained that there have been some problems with rent payments as her father has dementia and forgets to make the payments. She said that a payment of $975.00 was made this morning, bringing the current arrears to $975.00 (one week of rent). She was surprised that the landlord has applied to terminate the tenancy as she said that they have always been good tenants and kept the property in very good condition. She also raised her own concerns, which cannot be considered in the context of this hearing.
The landlord was unable to check and confirm the payment had been received this morning. However after some discussion the parties agreed that I could make an order for payment of the rent arrears by consent, and that they would meet either in person or by phone to discuss a sensible way forward.
As the parties have agreed to orders by consent I have suppressed the tenant’s name and the tenancy address as there is no public interest in those details being published.
