The Landlord attended the hearing. The Tenant answered her phone but could not be reached after the parties were disconnected from the call. The Tenant was phoned four (4) times and would not answer.

The Landlord has applied for termination of the tenancy for breach of the Tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

A 14-day notice was served to the tenant for breaches of the tenancy agreement. The Tenant has been hording items inside and outside the premises, in breach of her obligation to keep the premises reasonably clean and tidy. The notice was hand-delivered to the Tenant’s letterbox on November 20, 2023.

The date by which the breach was to be remedied was December 4, 2023.

The Tenant has failed to remedy the breach by removing the accumulation of excessive belongings at the property, which is deemed unsafe and unsanitary.

The Landlord has provided photographs proving the Tenant’s breaches. The home is unsafe with corridors and entryways being blocked by the Tenant’s belongings and it is also unsanitary.

I adjourned the first hearing for three weeks to give the Tenant an opportunity to tidy up the premises and remove the excess items. She has failed to do so.

I accept the Tenant’s evidence that she has been deeply affected by the loss of her father.

It would be inequitable to refuse to terminate the tenancy because the Tenant has not remedied the breach, which is serious, and her hoarding behaviour shows no signs of abating.
