[The tenant/s] must allow a representative of Ōtautahi Community Housing Trust and contractors employed by the Trust access to the premises on Wednesday 20 March 2024 during the hours of 8.30am to 4.30 pm to undertake work to the bathroom of the premises.

[The tenant/s] must not interfere with the contractors in their carrying out of the work required to the bathroom.

The application is adjourned.

A further one hour will be allowed for the next hearing of this application, scheduled before me at this court in approximately three weeks’ time.

The hearing will be listed as an in-person hearing but the parties may, if they wish, attend the hearing by telephone. Any party who wishes to attend by telephone must inform the Tribunal before the hearing and provide a telephone number on which they can be called at the time of the hearing.

Reasons

Both parties attended the hearing. Mr Olds and Mr Woodbury represented the landlord and Ms Scott attended as a witness. Ms Pirere attended with a support person, Mr Wood.

The landlord has been trying to obtain access to the premises to repair a leak behind the vanity in the bathroom of the premises. The work needed to repair the leak will involve pulling out the vanity from the wall, locating and repairing the leak, putting the vanity back in position and making good.

The landlord served a notice dated 8 February 2024 on the tenant notifying her that their contractors would be attending the premises on 16 February to carry out the work. The notice was sent by email and by post.

The tenant said that she does not access her email address and that she did not receive the notice until 15 February. In any case, the tenant received 24 hours’ notice of the intended entry and work.

The tenant said that it was not convenient to her to allow access and have contractors on the premises on that day. She did not allow access and she has not allowed access or made any attempt to arrange access for the contractors.

At the hearing today, she confirmed that she would allow access although it would be inconvenient for her not to have ready access to the bathroom. There was some discussion about that, and the parties understood that if the tenant needed to access the bathroom when the contractors were working in there, that would be accommodated.

I have therefore made an order requiring the tenant to allow access on a date agreed by the parties and not to interfere with the contractors in carrying out the required work. Given the tenant’s agreement, the order should not be necessary but given the background, the landlord is entitled to the protection of the order. The landlord is not required to give any further notice to the tenant in relation to the entry on 20 March, but it agreed to remind the tenant nearer the time.

The landlord’s contractors should be able to locate and repair the leak on the day and restore the bathroom so that it can be used normally. But contractors will need to return to the premises to make good, including plastering and painting. I have not made any order in relation to that access, and it should not be necessary to do so. But in case there are any further difficulties, I have adjourned the application to a hearing in approximately three weeks.

If the landlord does not need a further order from the Tribunal, it should inform it that the hearing can be cancelled.

The parties may attend the next hearing by telephone if they wish by notifying the Tribunal and providing a contact telephone number.

The parties will be notified in writing by Tenancy Services of the date and time of the next hearing.
