Reasons

Both parties attended the hearing.
The tenant has claimed compensation from her former landlord because she said they unreasonably rejected her proposed assignee. She has asked for compensation for the double rent she paid for the house as well as for the new tenancy. She said she spent some time finding an assignment that would be the right fit and she was happy that the person she chose could pay the rent, get on with the others in the house, and had good references.
The landlord said that as part of their process for screening new tenants they check previous Tenancy Tribunal decisions. They found a recent decision where the proposed assignee brought a claim against a landlord. They read the decision and on the strength of that they did not agree to the assignment.
I have considered the submissions and read the Tribunal order. I find that it was reasonable for the landlord to rely on the order in the particular circumstances of this case. The proposed assignee left her tenancy without giving notice. Regardless of the reasons, the back story, and the motivation for filing the application, the order found that there were no legal grounds for her to do so. This meant she owed 28 days rent in lieu of notice, and an order was made against her refunding the bond in full to the landlord. The tenant’s claim is dismissed.
I have allowed suppression for both parties because: • there have been no breaches of the Residential Tenancies Act 1986 • any public interest is in the law and not the names of the parties • parties are encouraged to use the Tribunal to resolve disputes. See section 95A RTA.
