Order
- Ngan Nguyen must pay the sum of $5070.24 to [The landlord/s], comprised of the rent arrears to 11 February 2024, plus the filing fee.
Reasons
- Only the landlord attended the hearing.
- The tenancy started on 6 November 2023. It was a fixed term tenancy for year.
- The tenant paid the first two weeks of rent and then paid nothing further. She said she was returning to Vietnam for holiday. She asked could she pay rent monthly, but she has not paid anything.
- The landlord’s last communication with the tenant was in March, when the tenant asked could the landlord deliver her belongings to a friend’s house. At that point, the tenant said she was not returning to the tenancy.
- The landlord then arranged to deliver all the tenant’s belongings to her friend’s place. It was a truck full of belongings. There were around ten to twelve bags.
- There were also two cats there. They seemed well fed and the landlord assumed someone was feeding them. Photos were provided and they looked like pedigree cats.
- The property manager kept the cats for a few days and then these were also dropped to the friend’s place at the request of the tenant.
- The landlord was initially asking for an order to dispose of the remaining belongings but that is no longer needed.
- The landlord has provided rent records which prove the amount ordered for rent as above.
- The claim for other compensation was abandoned due to lack of adequate evidence. The landlord was offered the opportunity to adjourn to obtain that evidence but declined.
- The filing fee is to be reimbursed as the landlord has succeeded with its claim.
