Order
- The Tribunal’s order dated 26 September 2024 is amended to correct the table in Order 2, which should read “Total payable by Landlord to Tenant” rather than “Total payable by Tenant to Landlord”.
Reasons
- On 26 September 2024, the Tribunal issued a decision, which ordered the landlord to pay money to the tenant. This was clear from the main text of Order 2 which read, “2. [The landlord/s] must pay [The tenant/s] $1,520.44 immediately, calculated as shown in the table below: Description Landlord Tenant Exemplary damages – failure to lodge bond $500.00 Exemplary damages – breach of quiet enjoyment$1,000.00 Filing fee reimbursement $20.44 Total award $1,520.44 Total payable by Tenant to Landlord $1,520.44”
- However, due to a typographical error, the table in Order 2 read “Total payable by Tenant to Landlord” rather than “Total payable by Landlord to Tenant”, which it should have read. That error is corrected in this corrigendum, so the original order should be read as an order that the landlord is to pay the tenant $1,520.44.
