The order made on 26 April 2024 is the final order regarding this application.
I am satisfied that the premises rented by the landlord to the applicant is a lawful residential premises.

Reasons

All matters raised by the tenant in her application were addressed in the order dated 26 April 2024. The adjournment in that order was to consider whether the premises the tenant occupied was a lawful residential premises.
The Tribunal may declare premises to be unlawful residential premises and may make orders on its own initiative, even if the tenant has not applied for a particular order. See sections 78A(3)(a), (4) and (5) RTA.
The landlord has provided evidence to the Tribunal relating to the lawfulness of the premises for tenancy purposes. I am satisfied that the premises are lawful residential premises. The premises also meet Healthy Homes Standards. There has not been a breach by the landlord regarding the obligation to provide lawful residential premises. Name Suppression
