Repair: i.The downstairs bathroom’s ceiling. ii.Repair kitchen top cutlery drawer. c. The tenants claim that the ensuite toilet’s flush button is broken, the downstairs bathroom’s ceiling has not been reinstated, the cutlery drawer is broken, the ensuite bathroom’s extractor fan is malfunctioning, and the downstairs and kitchen lights need repair. Under s 45(1)(b) of the Residential Tenancies Act 1986, the landlord must provide and maintain the premises in a reasonable standard of repair.
Where the Tribunal finds the landlord has failed to comply with an this obligation, it may make an order for the landlord to carry out the work under s 78(1)(e) of the Residential Tenancies Act 1986.
If the work order is not being made by consent of both parties, the Tribunal must also make a monetary order as an alternative to compliance with the work order. However, in this case the work orders are made by consent of both parties so an alternative monetary order is not required.
The landlord has attended to some but not all of the maintenance issues the tenants complained about in their claim to the Tribunal. A toilet flush button has still not been repaired, and there is still a hole in the bathroom ceiling a contractor made when he investigated a leak from the laundry above.
It appears the tenant’s washing machine pipes were incorrectly fitted, causing the leak.
I am satisfied that the landlord has failed to provide and maintain the premises in a reasonable standard of repair in respect to the flush button.
Today, the tenants added further maintenance problems to those raised earlier: the cutlery drawer has broken, the ensuite’s extractor fan is malfunctioning, and the downstairs and kitchen lights are not working as they should.
The Tribunal makes the work order set out above, by consent of the parties. Compensation
The tenants spent $333.00 to replace a pantry light and for a contractor to assist in tidying up the garden, which they say had not been provided tidy.
The tenants spent a lot of their own time tidying the garden and clearing rubbish left at the premises, for which they seek compensation.
However, Mr Li says that the tenants should pay for the ceiling repair cost.
In my view, the tenants’ costs and the inconvenience to them, and their contribution to the ceiling costs cancel each other out.
Therefore, no order for compensation is made. Filing fee
No order is made for reimbursement of the filing fee because both parties have substantially succeeded in the proceedings. Non-publication
The tenants seek an order for non-publication of their names and identifying details.
The Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published, unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case. 1
