The tenant, one of two under the tenancy agreement, gave notice to the landlord on 26 January 2024 that she wished to terminate her tenancy. A notice of termination of a periodic tenancy given by one tenant under a joint tenancy is effective to terminate a tenancy, even if another tenant does not agree.

The landlord wished for the tenant to assign her interest in the tenancy agreement to one of the flatmates living at the property. The tenant signed the required document but did not complete the transfer of the bond form.

The landlord confirmed with the continuing tenant and the new tenant by email on 27 February 2024: “The Tenancy Variations will not be implemented until the Bond Dispute has been resolved. Once the Bond is sorted, then the variations will be implemented.”

The tenant and the continuing tenant(s) have a dispute regarding the amount payable by the tenant for repairs to a wall in her room at the property. The tenant advised that the new tenant undertook repairs to the wall and has invoiced her directly. The landlord explained that this was an issue for resolution between the tenant and the continuing tenants as it was not work initiated by the landlord. As noted, there has been no cross-application made by any party.

The tenant terminated the tenancy by giving notice. Section 22B(2) Residential Tenancies Act 1986 provides that, where a tenant applies for refund of the bond, and the landlord seeks payment from the bond, the landlord must file an application setting out the details of the counterclaim. Because the landlord has not filed a counterclaim, the bond amount paid by the tenant is to be refunded in full to the tenant.
