Reasons

The landlord attended the hearing. There was no appearance for Mr Kaiui.
The landlord has applied for termination of the tenancy on the basis that Mr Kaiui has threatened to assault a neighbour, see section 55(1)(c) Residential Tenancies Act 1986.
The landlord has provided evidence that on 7 March 2024 Mr Kaiui knocked on the door of another of the units in the building which houses the tenancy address (this is a block of flats providing state housing). He was aggressive and abusive and said he would stab anyone who walked past his unit. An entrance into the building is past his unit.
He then allegedly banged on the doors of other units and smashed a window in the internal corridor of the property. The Police were called and removed Mr Kaiui, however he returned the following day.
The occupants of the other three units are all vulnerable tenants and concerned for their safety. One is temporarily staying away, and the other two families have been offered emergency temporary housing by the landlord.
I am satisfied that the landlord has established to the evidential standard that Mr Kaiui has threatened to assault a neighbour and has damaged the property. Accordingly, I must terminate the tenancy.
Because the landlord was successful in their claim, I approve their application for suppression.
