Order

[The landlord/s] must take any of the tenant’s personal documents that have been left at the premises to the nearest Police station and obtain a receipt for them.
The landlord may dispose of the other goods left at the premises by the tenant as the landlord sees fit.

Reasons

Both parties attended the hearing which was held by teleconference.
The landlord has applied for the disposal of goods the tenant left at the premises at the end of the tenancy.
The tenancy was terminated by the Tribunal on 26 February 2024 due to significant rent arrears. The tenant was evicted in March 2024. He had not removed all his possessions which remain at the premises.
The landlord advised that he had given the tenant two opportunities to collect his belongings. On the first occasion, the tenant picked up a few small items. The tenant did not show on the second occasion.
The tenant disputed the landlord’s version of events. The tenant explained that he is unwell and has mobility issues. He had to arrange for someone to help him remove his belongings but could only collect some of his belongings due to restrictions by the landlord.
After discussion, the tenant accepted that the remaining goods at the premises were of no value and could be disposed of. The landlord confirmed that he had contacted the hospital to collect other items which it had provided for the tenant’s use.
The value of the goods is below the cost of storing, transporting and selling them. Therefore, the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.
