Reasons

The landlord attended the hearing, the tenants did not attend.

This was a cross application. The tenants were claiming compensation from the landlord for supplies and work done to the property. I am dismissing the tenants claims as they did not attend the hearing to advance their claims.

The landlord has applied for possession of the premises occupied by the tenant.

This is a boarding house tenancy. The landlord advised the tenants in writing on 27 December 2023 that they were demolishing the property and they had 28 days to vacate the property.

The tenants remained in the property after the termination of the tenancy. The tenants are living at the property and have their personal possessions there.

The landlord has given the tenant notice terminating the tenancy and the tenant has not quit the premises within the period specified in the notice. See section 66Y Residential Tenancies Act 1986.

The landlord is entitled to an order for possession of the premises. See section 66Y Residential Tenancies Act 1986.

The landlord has immediate possession of their property. Disposal of goods

The landlord has applied for the disposal of goods the tenant left at the premises at the end of the tenancy.

The landlord has not had communication with the tenants. The tenants have 7 days from the date of this order to contact the landlord and arrange a time to collect their property.

The value of the goods is below the cost of storing, transporting, and selling them. This was a furnished property and the tenants’ possessions are mainly clothing and personal items. The landlord may dispose of the goods after 7 days if the tenants have not collected their property. See sections 62(3)(b), 62B (2) and (3) Residential Tenancies Act 1986.

The landlord has applied for suppression of their name and details. As the landlord has been successful with their application, I will grant suppression of their name and details.
