Reasons

The phone number for Mr Stone, representing the landlord, the last three digits being 231, was called 4 or 5 times in the 10 minutes after the hearing start time. All calls to him went to voicemail. The tenant, Mr Field, initially answered the phone, was told the hearing was about to proceed but I would try the landlord again first and call him back in a few minutes, which Mr Field was fine about. I made 3 subsequent calls to Mr Field, the tenant, all of which went to voicemail.
The applicant did not attend the hearing at the scheduled time, request an adjournment, or notify the Tribunal the matter has settled. See sections 78(1)(i) and 92(1) Residential Tenancies Act 1986.
The other party did not attend the hearing either, after initially being contacted, as above.
I note that three scheduled hearings of this application have been adjourned so far all at the request of the landlord. These were hearings on 22 April 2024, 22 May 2024 and 2 July 2024.
Further, an email request to the landlord sent by the Registry on 9 August 2024 as to whether the landlord wished to proceed with their claim, asking the landlord to clarify the correct landlord for the matter, providing a complete rent summary and other issues, went unanswered.
From the application documents, it is clear that the grounds the landlord initially filed this application upon, being abandonment of the property, have changed significantly since the application. There is not much, if any, recent evidence of the current situation with the tenancy that has been provided by the landlord.
Given the landlord did not attend the scheduled hearing, and taking into account the number of adjournment requests by the landlord, the lack of current evidence provided by the landlord, and the landlord’s lack of response to requests from the Tribunal, I dismiss the claim.
