Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate (section 56(1) of the Residential Tenancies Act 1986).

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant breached her obligations by not keeping the premises reasonably clean and reasonably tidy. The inspection reports for June 2023 and January, April and May 2024 show a significant problem with hoarding. Much of the living space in the unit is covered in plastic bags of the tenant’s clothes and other belongings. The landlord expressed concern that this could interfere with the ability of the tenant to exit the premises in case of fire, and this view is reasonable. I also understood that the belongings at one stage blocked a drain in the bathroom, causing a leak into premises below.

The landlord served notices to remedy on 7 November 2023 and 24 January 2024, and the tenant did not remedy the breach within the required period. The landlord advised that previous efforts to remove the belongings from the premises have been unsuccessful. When items were put into a skip bin, for example, the tenant retrieved the items. The landlord explained that they are arranging mental health support for the tenant so she can transition into more appropriate housing. The Tribunal’s order will assist with this.

The breach has continued for some months. The available evidence suggests that an order to remedy the breach would be unlikely to prevent the problem from quickly reoccurring.

For these reasons, notwithstanding the length of the tenancy (over 4 years) I find that it would be inequitable to refuse to terminate the tenancy. Name suppression
