Order
- The tenancy at Unit/Flat 2, 1A Birkenhead Avenue, Birkenhead, Auckland is terminated and [The landlord/s] and [The landlord/s] are granted possession of the premises at Unit/Flat 2, 1A Birkenhead Avenue, Birkenhead, Auckland 0626 at 8am Tuesday 14 May 2024.
- [The tenant/s] and [The tenant/s] must pay [The landlord/s] and [The landlord/s] $2,430.44 immediately, being rent arrears to 13 May 2024 plus the filing fee of $20.44.
Reasons
- Both parties attended the hearing which was conducted remotely. Mr Ranaweerage confirmed that he had authority to speak for both tenants.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord agreed that the tenant may remain in the property for a further week.
- The landlord provided rent records which prove the amount owing up to 13 May 2024 is 2,410.00.
- Because [The landlord/s], [The landlord/s] has wholly succeeded with the claim I must reimburse the filing fee.
