Reasons

Both parties attended the hearing.
The landlord sought rent arrears of $822.86 on the basis that the tenancy commenced on 22 March 2019 and rent was paid to 18 December 2023. The tenancy ended on 30 December 2023.
The tenant agrees that rent was paid to 18 December 2023, that the tenancy ended on 30 December 2023, however he says that the tenancy commenced on 25 March 2019.
It is common ground that the tenancy agreement includes a start date of 22 March 2019, however the tenant’s position is that move in was delayed until 25 March 2019 by the need the fix and secure the back door. This is supported by a letter from his carer.
The property manager in the hearing was not managing the property at the time of the commencement of the tenancy. However, he provided information that the owner disputed that the tenancy commenced later, indicating that he makes a habit of noting the actual start date of each tenancy on the top of the document to assist him remembering if disputes arise. The date of 22 March 2019 is noted on the top of this agreement. However, it is not possible to know if that is for the purpose the landlord states or for ease of location in a filing cabinet, as I note the address of the tenancy is also written on the top of the agreement.
On balance I accept the evidence of the tenant on this point. He was very clear about details such as the date he pays rent, and other matters which tend to support his credibility.
This is not a criticism of the landlord, but in the circumstances evidence of an “ordinary practice” does not outweigh the tenant’s evidence of specific events.
Accordingly, the amount ordered is proved.
