The tenancy is for part of the house at [Tenancy address suppressed]. There are four bedrooms in the house. Ms Muriwai’s tenancy was for two bedrooms, with shared use of the kitchen, bathroom, and other amenities.

During Ms Muriwai’s tenancy there were two problematic tenancies of the other two bedrooms.

The first was involved [flatmate 1] and her family.

Ms Muriwai brought [flatmate 1] and her family into the house. Ms Muriwai said that [flatmate 1] and her family were homeless. She allowed [flatmate 1] to occupy the two bedrooms. [Flatmate 1] paid a sum of money to Ms Muriwai.

[The landlord/s] was not aware of this. When he found out about it, he agreed to allow [flatmate 1] and her family to occupy the other bedrooms and pay rent to him.

[The landlord/s] believed, incorrectly, that he had not granted [flatmate 1] a tenancy because he did not enter into a written tenancy agreement her.

Problems ensued between Ms Muriwai and [flatmate 1]. Ms Muriwai said that the problems were due to [flatmate 1] not respecting her or the shared living arrangements – she said that [flatmate 1] was untidy and rude, that there was drug use, and that [flatmate 1] allowed her dog inside the house.

She raised these concerns with [The landlord/s], but [The landlord/s] did not take any action.

Ms Muriwai gave [flatmate 1] notices to end her tenancy, then issued her a trespass notice, and then physically removed [flatmate 1] from the property.

The second problematic tenancy involved [flatmate 2] and her partner.

Ms Muriwai became unwillingly involved in a violent domestic incident between [flatmate 2] and her partner that occurred at the property. The incident ended with [flatmate 2] causing substantial intentional damage to the house.

I am satisfied that there are grounds for termination of the tenancy due to: a. Ms Muriwai unlawfully allowing [flatmate 1] to occupy parts of the house that she had no right to. 1 b. Ms Muriwai forcibly removing [flatmate 1] from the house. 2

The tenancy will terminate at 12.00 noon on Monday 14 October 2024.

The landlord has been successful in this application.
