Reasons

Both parties attended the hearing.

The Tenant accepts she has refused to allow the Landlord entry to the premises for the purposes of conducting a routine inspection and assessing the premises for the purpose of the Healthy Homes Standards (HHS).

The Tenant says she will actively resist entry to the premises if I grant it. She confirmed she is likely to be hostile if the Landlord attempts to access the premises pursuant to a Court Order.

Initially, I had asked the Landlord to go away and have a careful think about the feasibility of access given the Tenant’s evidence, and to confirm its position in writing to the Tribunal.

The Landlord has emailed the Tribunal requesting an Order as to entry on 29 May 2024 at 10am. I appreciate my directions were not precise, I had merely asked the Landlord to go away and deliberate and return with a comprehensive response which showed the safety of the Tenant and those accessing the premises had been considered. I trust the Landlord has grasped the seriousness of the matter.

I have Ordered entry at the days and times in the Order to ensure the Landlord and its contractors have sufficient time to complete the work they have set out to do, and, principally, to ensure the premises comply with the requirements of the Act and HHS. I do this despite the Tenant’s request that inspections are not done at the premises, and specifically, that the premises are not brought into compliance with the HHS if they do not already comply.

The Tenant has asked that her wish to be left alone is respected. However, I consider she does not have to be at the premises on the days and times the Landlord has been permitted to access the premises pursuant to this Order.

I have granted the Landlord’s application but would urge caution given the Tenant’s position. I am granting the Landlord’s application for entry pursuant to sections 48, 77 and 78 of the Residential Tenancies Act 1986, recognising its right to enter the premises for the reasons sought however, in doing so, I record the Tribunal’s position that it would not endorse entry if it was likely to result in harm to any person or damage to property.

A copy of this Order should be provided to the Directors/Board of Accessible Properties Limited.
