Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On March 9, 2024, the landlord attempted to reach their tenant multiple times via phone and email, eventually leaving a note on the door.
A friend of the tenant informed the landlord on March 24 that the tenant had been arrested.
The property had been neglected, with food spoiling in the kitchen and the garden overgrown. The tenant's advance rent payment expired on March 21, 2024.
The landlord contacted the Police, who confirmed the tenant's arrest and ongoing imprisonment.
The landlord also reached out to the tenant's official contact, Reverend Kevin Denholm, for updates on the situation.
Despite numerous attempts to contact the tenant, they were unable to communicate directly due to their incarceration.
Supporting documents for abandonment were provided, including photos of the neglected property and a log of contact attempts.
Rent arrears amounted to $1,710.00. I make no award of rent arrears because I understand from the Landlord that only termination is sought and she has a separate application before the Tribunal which includes the rent arrears.
The Tenant is incarcerated. Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
