The tenant acknowledged that his response was intemperate but did not accept that he threatened the employee.

This incident occurred in mid-January of this year. The landlord’s application was filed in May 2024. The tenant has been living in the property without any similar incident for over six years and the landlord accepted that the tenant had not caused any other issues during this period.

The Tribunal is not satisfied on the balance of probabilities on the evidence before the Tribunal that the tenant threatened to assault the employee.

The landlord’s application must therefore be dismissed.

As the landlord’s application has been unsuccessful, it is appropriate to suppress the tenant’s name.
