The applicant claims that the premises at the beginning of the tenancy was not reasonably clean and tidy. At the time the landlord agreed and paid for a professional cleaner. This inconvenienced the tenant and I understand that he could not move in for four days after the tenancy started.

The landlord offered compensation of one weeks rent relief to be applied at the end of the tenancy. The tenant said he could have applied to the Tribunal at the time but chose not to. When the tenancy ended the landlord honoured the one weeks rent relief.

The applicant claims that he was charged for a meth test at the end of the tenancy. The meth test was part of the early termination costs that the tenant agreed to when he accepted the terms to end the tenancy early. While normally a tenant would not be responsible for meth testing this cost is a consequence of the fixed term tenancy ending early and is a cost that the landlord would not have had until the tenancy was due to end in six months’ time.

The applicant also queried other costs in the early termination costs but after considering the communication around this issue and the invoice issued to the tenant, I consider that the costs were actual costs incurred and as such it is reasonable for the tenant to be responsible for them.

On the evidence I am not satisfied that the tenant is entitled to any compensation following the end of the fixed term tenancy. The early termination costs charged by the landlord, which had been agreed to by the tenant, were reasonable.

While the tenant considers that the landlord should have handled the situation differently to avoid his stress, I do not find anything in the actions of the landlord that warrant compensation.
