I am satisfied that the tenant had received proper notice of the hearing time, date and place and chose not to attend.

The tenant was sent the notice of hearing on 17 June 2024 by email to the email address she has been using yesterday and today to communicate with the Tribunal. She was also sent follow up reminders about the hearing today by text message.

The tenant emailed the Tribunal registry at 9:32pm last night to say she had just realised the hearing was set down for today at 11:15am and she couldn’t make it and she requested the hearing be adjourned. We received this message at 8:30am this morning. The tenant did not give the Tribunal a justifiable reason for granting her an adjournment. The Tribunal’s time is scarce, and it has a waiting list of cases to hear. Adjourning matters at the last-minute means that time is wasted as it cannot be allocated to the hearing of another matter.

The central registry informed the tenant by email that if she did not attend today’s hearing it would go ahead without her. She was also informed the hearing today was to determine if the Tribunal had jurisdiction to hear her claims against the landlord.

The North Shore Registrar called the tenant and the tenant agreed to attend by telephone. She was told she was being put on hold until we got the landlord party into the hearing room. By the time the landlord was in the hearing room, the call had been disconnected. I made 4 attempts to call the tenant and on the last call I left a voice message telling her I would call back in 5 minutes and if she did not pick up the phone, I would dismiss the application. She did not pick up my next call.

From the evidence the landlord produced, the tenant was a boarder or flatmate in a large house. The landlord says the tenant had exclusive rights to occupy her bedroom and to use the shared facilities. Further, the landlord says the tenant agreed to assist the landlord with some meal preparation and housework. He is a solo father of two girls and says he got a flatmate to help by providing this type of assistance.

The tenant has provided very scant evidence to the Tribunal in support of her assertion this was a residential tenancy. She says she resided in a totally separate dwelling to the main house. This conflicts with what the landlord asserts. I am unable, in the tenant’s absence, to make any finding as to whether the Tribunal’s has jurisdiction over the tenant’s claims. As such, her application is dismissed for lack of evidence to prove the Tribunal has jurisdiction and for failing to appear at the hearing today without a justifiable reason.
