On 21 June 2024, the landlord filed a second application seeking possession of the premises.

The tenant’s application and the landlord’s new application were heard before me at [Event location suppressed] on 5 July 2024. Ms Kathy Hansen and [The tenant/s] attended the hearing. Ms Timmins and Ms Loane attended on behalf of Ray White. Landlord application

The application seeks possession on the grounds that the tenancy terminated on 12 June 2024 pursuant to a 63-day termination notice issued by the landlord on 9 April 2024.

The notice states that the tenancy is terminated because the premises are required as a place of residence for the owner or a member of the owner’s family.

At the hearing, Ms Hansen said that following the death of her mother the family’s intention is to sell the premises. Ms Hansen confirmed that neither she nor any other member of her family intends to move into the premises occupied by [The tenant/s].

I accept that a genuine change of plans has occurred. It is not the case that the landlord issued notice to terminate under false pretences 1 .

However, the stated grounds for the termination no longer apply. The premises are not required by the landlord or a member of the landlord’s family.

The landlord can terminate the tenancy on the grounds that they intend to put the premises on the market for sale 2 , but they will need to issue a new termination notice.

The tenancy has not terminated, and I cannot make an order for possession.
