Tenancy Tribunal case 4875020 — Rubbish Removal at 14 Hamilton Street, Pahiatua, Pahiatua 4910
Decided 24 Jul 2024 · Published 24 Jul 2024 · Application 4875020
Landlord favoured
- Rubbish Removal
Order
- Michelle WILKS must pay Trust House Limited $1,966.26 immediately being the cost of rubbish removal of $3,117.54 less a credit for funds on hand of $1,151.28.
Reasons
- The landlord attended the hearing by telephone.
- The tenant did not attend the hearing.
- The landlord has applied for the cost of removing a substantial amount of rubbish from the premises at the end of the tenancy.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, and remove all rubbish. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The landlord provided photographic evidence that the tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
- The landlord advised that it held a credit in its trust account on behalf of the tenant. It is appropriate that this sum be used in part-payment of the amount payable by the tenant for the rubbish removal.
- The amount ordered is proven.
