- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit: s 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The Landlord has provided photographs which corroborate the Landlord’s claim that the Tenant, after being given a breach notice in respect of the condition of the premises, abandoned the tenancy and did not both to clean the premises, or remove his rubbish. I award the rubbish removal costs of $290.00 and cleaning costs of $373.75 to the Landlord.
- The tenant did not return the keys. Three locks required replacing. I award the Landlord $297.64.
- The lawns and yards needed cleaning, as the Landlord’s photographs make out. I approve the Landlord’s claim of $260.00.
- The amounts ordered are proved.
- Because J C Realty Limited has wholly succeeded with the claim I must reimburse the filing fee of $20.44.
