- The tenant must, by 9 September 2024, remove the items from the landing outside the premises, from the stairway to the outside door and outside in the garden and paved areas including, but not limited to, the shelving unit on the landing and the items on it, the drapes and rubbish bin in the stairway and the mop, weed mat, security light and rake outside.
- If the tenant fails to comply with this order, then the landlord may undertake the work and charge the tenant the costs of the work up to $200. That cost may be treated as rent in arrears and enforced accordingly.
- [The tenant/s] must pay Rentworks Property Management 2018 Limited as Agent for Redoubled Ltd $20.44 filing fee immediately.
Reasons
- Both parties attended the hearing.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.
- I adjourned the previous hearing to allow the tenant time to remove the items that have been left outside her unit and around the property. She has not done so. Instead of deciding on whether to terminate the tenancy, and after discussion with the parties, I have made a work order with provision for the landlord to remove the items if the tenant failed to do so and charge the tenant the cost of the work. I hope that the tenant will do the sensible thing and remove the items.
- The landlord has succeeded to some extent and so I have ordered the tenant to pay the filing fee.
