The tenancy of Kiri Waahi at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 23:59 Thursday 11 July 2024.
Kiri Waahi must pay [The landlord/s] $20.44 immediately, being the application filing fee.

Reasons

The landlord attended the hearing.
The matter was adjourned on 17 June 2024 after the landlord application was varied to consider termination per ss 55 and 56 Residential Tenancies Act 1986 (“RTA”).
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The landlord received advice from the tenant and support agencies she had moved towns. The tenant is required to live at the premises. A return to property notice was served on the tenant on 10 May 2024. By the date of the 27 May 2024 expiry the landlord stated the tenant has not returned. Further checks since the last hearing have confirmed this to be the case.
It would be inequitable to refuse to terminate the tenancy because the tenant is not residing at the premises. This is depriving others of social housing benefit. Further, other, unknown, persons are in occupancy at the tenancy address. The landlord is having to manage behaviour issues of one or more of these occupants and the adverse impact on the neighbours.
Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
