Reasons

Both parties attended this remote teleconference hearing.
The applicant is required to establish the claim to the civil law standard of proof, on the balance of probabilities.
The landlord claims are for rent arrears and compensation for damage.
The tenant in these proceedings, was the tenant when this tenancy commenced in May 2107.
The tenant lived at the premises with his son Jack.
In May 2023, the tenant informed the landlord that he wished to assign the tenancy to his son. By email dated 23 May 2023, the landlord confirmed that this was acceptable and provided change of tenancy forms for the tenant and his son to complete.
The form was completed and returned to the landlord.
The landlord accepted in evidence that they had failed to file the forms.
For the reasons set out above, I dismiss the claim against this tenant, as he was not the tenant when the claims raised by the landlord at the time relevant to these claims.
Both parties have applied for name suppression. In the circumstances set out above, I do not consider that there is any public interest in the outcome and suppression of the party names and details is ordered.
