The landlord had applied for termination for rent arrears, unpaid water rates, and a breach of the tenant’s obligation to keep the property reasonably clean and tidy and remove all rubbish that arose out of an inspection on the 8 May 2024 and for which a s56 breach notice was given.

The landlord tells me that the tenants have made a concerted effort to remedy all of the breaches and as at today it was no seeking termination.

The tenants have paid the rent arrears.

The tenants have cleaned up the property and mown the lawns. There remains some rubbish at the property which the tenants say they have arranged to have removed.

The tenants have tried to have the carpet cleaned but the carpet cleaner that they engaged told the tenants that they had to use a more specialised company due to the nature and extent of the stains. The tenants have organised this.

The landlord intends to re-inspect the property on the 16 August to ensure compliance with all the issues outlined in breach notice of 8 May 2024. The tenant should ensure that the house is reasonably clean, and all the rubbish has been removed.

There is a water rates notice of $474.53 which is for the current month, this is because when one of the tenants were away the tap on that side of the house developed a leak. The other tenant did not notice it for a few days, when the tenant notified the landlord, it was noted that the leak needed to be fixed, unfortunately this resulted in a lot of water being used. The landlord has asked the water provider for a leak rebate, but they have refused. This provider (Veolia) does not give leak rebates. I ask that the parties approach Veolia and ask them to reconsider this position, as it seems unfair that the tenant is being charged at the full commercial rate for this water. I know that other water providers in other regions give leak rebates (or at least reduce the rate charged) in these types of situations. I have also explained to the tenants that they are liable for the water usage. I have suggested that they try and seek assistance from MSD as they are in receipt of benefits.
