Harry Tuwhakaea Clark owes Kāinga Ora–Homes and Communities $13,837.15 (“the debt”) being rent owed to Thursday 22 August 2024.

Harry Tuwhakaea Clark must pay rent and the debt as follows: a. By fortnightly payments of $100.00 for the debt in addition to the weekly rent due. b. Payments will be every other Thursday, with the first payment on 22/08/2024 and continuing fortnightly until the debt is repaid in full.

Payments will be allocated in the following order: rent and then rent arrears.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at Unit/Flat Flat 12, 2 Anzac Road, Morningside, Whangarei 0110 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

The tenant explained the difficult circumstances leading to him having no income for some weeks that have contributed to the current situation and the high rent arrears. He is in the process of addressing these issues and stated that he has now applied to WINZ and Kiwisaver for assistance. His partner has agreed to assist, and agreement was reached today that a minimum of $100 per fortnight will be paid towards the arrears commencing on 22 August. This amount is in addition to the weekly rent due which must be paid.

The rent is currently $457.00 per week and the tenant is aware that this is the current weekly rent to be paid, however, he has applied to MSD for a rent reassessment and if this is successful the weekly rent may change.

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
