Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord’s name and identifying details.
- Tania Walker and Maunder Mahutu owes [The landlord/s] $1,997.58, being rent owing to today (“the debt”).
- Tania Walker and Maunder Mahutu must the debt on or before 9 September 2024 as well as the rent when it next falls due.
- If the tenant fails to pay the next rent payment and the debt within 2 working days of the due dates: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- If the tenant fails to pay the filing fee of $20.44 within 2 working days of the due date, the filing fee will be payable immediately.
Reasons
- Only the landlord attended the hearing. Calls to the tenants were unanswered.
- The landlord had applied for termination of the tenancy, rent arrears and refund of the bond.
- The landlord is entitled to terminate, because the tenant failed to comply with a 14 day notice to pay rent arrears and also at the date of the hearing, the rent had been owing for more than 21 days.
- The landlord is entitled to an order for termination but has requested a conditional termination, on the basis ordered above.
- On the limited facts so this case and since this is the request of the landlord, I am prepared to make the order sought.
- The conditional termination order will lapse if it is fully complied with.
- The landlord has applied for rent arrears and has provided rent records which prove the amount owing.
- Because [The landlord/s] has wholly succeeded with the claim I must reimburse the filing fee. It has succeeded and so I have ordered name suppression.
