Reasons
- The landlord attended the hearing. There was no appearance by the tenant. The hearing was delayed in case the tenant was running late. It commenced after that unsuccessful wait.
- The landlord has applied for rent arrears and has provided rent records which prove the amount owing after the tenancy ended 29 July 2024. The actual application was for termination but that waws moot as the tenant has now vacated.
- The tenant had applied for compensation.
- The tenant applicant did not attend the hearing at the scheduled time, request an adjournment, or notify the Tribunal the matter has settled. See sections 78(1)(i) and 92(1) Residential Tenancies Act 1986.
- Regardless, she had previously failed to provide any evidence to support the claims. There was compelling evidence available on file that, for a number of claims made, the landlord had adhered to requirements.
- In a letter to the tenant on 12 June 2024, Tenancy Services raised the missing information with the tenant, noting to her: - Timeline of events is nice to have - Any supporting documents for the claims that you have made - Any notices issued to the landlord by you regarding the issues you have raised - Any messages/emails to the landlord about the issues you have raised
- Nothing was subsequently received.
- The landlord waived any return of the application filing fee.
