Reasons

The landlord attended the hearing today.
The Tribunal made an order on 3 September 2024 dealing with rent arrears, outgoings, the bond, and certain repairs. The landlord amended the claim at that stage to include the cost of replacement carpet. This order determines the carpet claim and incorporates the previous order for enforcement purposes.
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage.
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or 4 weeks' rent. Where the damage is careless and is not covered by the landlord's insurance, the tenant's liability is limited to 4 weeks' rent.
The landlord’s exit inspection photographs showed that the carpets in the main house and sleepout were badly soiled at the end of the tenancy. I accept they needed replacement. A quote obtained by the landlord for replacement in both areas totalled $8,325.00 plus GST.
Insurers applied the excess of $650.00 to 4 rooms in the main house: the lounge, master bedroom, bedroom 2 and bedroom 3. I award this uninsured loss. Underwriters declined the claim for replacement carpet in the sleepout on the grounds that it was pet damage and therefore excluded. On this basis, the tenant’s maximum liability for the sleepout carpet is limited to 4 weeks’ rent ($2,580.00). Insurers assessed the cost of replacement at a lower price, $1,710.00, which is the amount I award.
The damage is more than fair wear and tear, and the tenants have not disproved liability for the damage.
The landlord’s application has now been fully heard and determined.
