Reasons
- Both parties attended the hearing.
- The Tenants had been living in main premises on the property but moved into a granny flat at the rear, and finally, vacated the granny flat went it became clear that they could still not afford the rent.
- The parties reached agreement concerning most issues, which I confirmed I would record in a binding Tribunal Order. The Order includes rent arrears from a previous tenancy. The Landlord brought rent summaries to the hearing, and the Tenant brought her bank records and both parties discussed how they would resolve matters, absent me.
- The parties have requested that I determine the outstanding balance of rent. The tenant did not inform the landlord of her move-out date. Considering this, along with the reasonable expectation for the landlord to proactively inquire weekly about the rent payments and occupancy status, I find that 1.5 weeks of rent is due. This figure represents half the total rent from the Tenants’ reported move- out date around 24 May 2024, to the date up to which the Landlord claims rent, 15 May 2024. This amount has already been awarded as outlined above.
