Decided 22 Aug 2024 · Published 22 Aug 2024 · Application 4914195
- Rent arrears
Party names are redacted in the official published order.
Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord’s name and identifying details.
- The Bond Centre is to pay the bond of $4800 ([Bond number suppressed]) 1 to [The landlord/s].
- The tenancy of Ofa Mavae, Makalofi Mavae and Samuela Mavae and [The landlord/s] at [Tenancy address suppressed] is terminated, with immediate effect.
- Ofa Mavae, Makalofi Mavae and Samuela Mavae must pay [The landlord/s] $4,007.28 immediately, calculated as shown in table below.
Reasons
- Only the landlord attended the hearing. 1 Provided by the Bond Centre to the tribunal following the hearing.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears and refund of the bond.
- The landlord submits the arrears are substantial and believes the tenants may have already vacated the property.
Should the tenancy be terminated?
- Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.
- The landlord issued a 14 day notice on 12 June 2024 regarding non payment of water bills. The notice was not complied with.
- Rent is at least 21 days in arrears at the hearing date. The tenancy is terminated.
How much does the tenant owe?
- The landlord has applied for rent arrears and has provided rent and other records which prove the amount owing as ordered above.
- Because [The landlord/s] has wholly succeeded with the claim I must reimburse the filing fee. I also consider it appropriate to order name suppression in its favour.
