Order
- By agreement, the term of the fixed-term tenancy of [The tenant/s] at [Tenancy address suppressed] is reduced and now ends at 11:59pm on Sunday 28 July 2024.
- The Bond Centre is to pay $1,420.56 from the bond of $2,800.00 ([Bond number suppressed]) to [The landlord/s] immediately in accordance with the following table:
- The balance of the bond of $1,379.44 is to remain at the Bond Centre.
Reasons
- Both parties attended the hearing.
- The parties contracted for a fixed term tenancy that is due to end on 1 April 2025. They have now agreed to end that tenancy early, this coming Sunday. Accordingly, I confirm their agreement by way of order.
- The landlord is entitled to reimbursement of their reasonable costs associated with the early termination. 1 They have provided an invoice establishing those costs and both parties have agreed that $1,000 will be paid from the bond to cover in part those costs. This is to settle any claim the landlord has pursuant to Section 44A Residential Tenancies Act 1986.
- The parties have also agreed that the remaining rent will be paid by the bond.
- Accordingly, to be clear, I record the parties’ agreement: a. The tenancy will end this coming Sunday, 28 July 2024. b. $1,000 from the bond will be paid to the landlord to compensate them for the costs they are facing associated with the premature ending of the tenancy. c. $441 will be paid from the bond to the landlord as the remaining rent obligations of the tenant’s up until the last day. d. The final inspection will occur on Sunday at a time agreed by the parties. If the property is returned to the landlord reasonably clean and tidy and without damage, 2 the remainder of the bond (that will still be retained by the Bond Centre) will be agreed to be reimbursed to the tenant and the parties will complete the bond refund form to that end.
