Reasons
- This application was scheduled to be heard by video conference. Ms Conway did not link in to the Teams link at the scheduled time and both times I called her mobile number my call went to voicemail. The hearing proceeded in her absence.
- The landlord has applied for compensation, payment of the remaining bond, and reimbursement of the filing fee following the end of the tenancy.
- I note that on 1 May 2024 there was an order from the Tribunal terminating Ms Conway’s tenancy for rent arrears. After payment of the rent arrears and the filing fee for that application from the bond, there was an amount of $48.14 left at the Bond Centre.
Did the tenant comply with her obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The photographs show that the tenant left the premises in a very dirty condition and left a lot of rubbish behind.
- The amounts ordered to remedy these issues are proved by invoices. Filing fee reimbursement
- I am also ordering Ms Conway to reimburse the filing fee to the landlord because the landlord was wholly successful in their claim against her. C ter Haar 28 August 2024
