The balance of the bond of $12.99 is to be held pending a further claim to be filed by the landlord for damage.

Reasons

Only the landlord attended the hearing. I am satisfied that the tenant has been served in accordance with the provisions set out in the Residential Tenancies Act and so the hearing was able to proceed in the tenant’s absence.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond on the basis that: a. The tenant has abandoned the property; and b. Rent was at least 21 days in arrears on the date the application was filed.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
The tenant was arrested on 28 March 2024 following an assault on a neighbouring tenant and remains in custody. On 2 April 2024 the landlord became aware that the tenant would not be returning had abandoned the premises. The tenant has not paid rent since that date. The landlord advised that the tenant’s release date is not known but it is not reasonable for the tenant to return to the property given the assault on the neighbouring tenant.
Because the premises have been abandoned, and rent is in arrears (and in this case more than 21 days in arrears at the date of filing), the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice.
