The tenants must carry out the following work to the premises, which must be completed by Thursday 5 September 2024: a. Repair a broken power point. b. Replace and paint two doors, supply and install three door handles, patch, sand and paint hole in door, supply and install hinges for kitchen cabinet, rehang cabinet door, supply and install broken window latch, supply and install new curtain rail and rehang curtains, dispose of damaged door.
If the tenant fails to comply with Order 3 above, then the landlord may undertake the work and charge the tenant the costs of this work up to $1,863.25.
The costs in Orders 2 and 4 may be treated as rent in arrears and enforced accordingly.
The application for further compensation of $1,098.00 for mould and graffiti removal and cleaning is dismissed.
The Orders are made with the agreement of the parties.

Reasons

The landlord and five of the tenants attended the hearing.
The landlord claims that the tenants have damaged the premises and wants the damages fixed.
Under section 40(1)(a)-(e), Residential Tenancies Act 1986, a tenant has specific obligations in relation to the tenancy premises.
Where the Tribunal finds, the tenant has failed to comply with any of these obligations, where appropriate it may make an order for the landlord to carry out the work. See section 78(1)(e) Residential Tenancies Act 1986.
A work order may also authorise the landlord to undertake the work and charge the tenant the costs of doing the work if the tenant should fail to comply with the work order. A monetary limit must be imposed by the Tribunal on the amount of costs that can be charged. These costs can be treated as rent in arrears and enforced accordingly. See sections 78(2AAB) and 78(2AAC)(a) Residential Tenancies Act 1986.
Suppression of all parties names and identifying details is granted pursuant to section 95A(4) because I consider it is in the interests of the parties to do so as they have reached a settlement of the claims.
