The tenant was of the view that the landlord’s actions in bringing its most recent application were in retaliation to a previous order of the Tribunal in relation to the same tenancy where the tenant had had some success.

Some of the matters raised by the landlord in its new application had been dealt with under a previous order (4645297).

The landlord had claimed $16,000 for repairs to piles where the previous order (following a Tenancy Services investigation) had already found that the landlord was in breach of its obligations as regards the state of the floor and awarded the tenant compensation for that and other breaches.

The landlord cannot make fresh claims for matters that have already been the subject of a Tribunal order.

Additionally, the tenant had gone to much effort to provide information to support her defence to the landlord’s claims and, given that she suffers ill health and that the travelling to attend the hearing is not easy for her, the whole process has been very stressful for her.

The tenant was further distressed as she considered that it was possible the landlord could make a new application transversing the same matters and it is now over a year since the tenancy ended and she wishes to move on.

Given the background to this application, the landlord should be aware that any further applications on its part traversing the same claims may be considered an abuse of process.

As [The applicant/s] has been awarded name suppression in previous orders in relation to this tenancy and as the landlord withdrew its claim at the last minute, name suppression is awarded to the tenant.
