Order
- The tenant owes the landlord the sum of $1,152.77 being outstanding water rates (“the arrears”).
- The parties have agreed that the tenant is to pay the arrears by weekly payments of $150.00 starting next Thursday 22 August 2024.
- In the first week of each month, the landlord will send a statement to the tenant showing the payments received and the balance outstanding of the arrears.
- The parties’ names are to be suppressed.
Reasons
- Both parties attended the hearing by telephone.
- The landlord’s application was for an order for unpaid water rates.
- The tenant has accepted that there are water rates outstanding and has been making regular payments. The amount owing has been reduced by nearly one half since the landlord made its application.
- The landlord agreed to the tenant continuing to make payment of the arrears by weekly payments of $150.00.
- The landlord agreed at the hearing to forward to the tenant by email in the first week of each month, a ledger for the payments which have been made and which shows the balance of the arrears owing at the end of each month.
- The landlord’s application could have been referred to mediation so that the parties could agree a repayment plan. In that event, the parties’ names would not have been published.
- As the parties reached agreement by consent at the hearing as to a payment plan and the amounts involved are relatively minor, it is appropriate that the parties’ names and details be suppressed as they would have been had I referred this application to mediation.
