Tenancy Tribunal case 4940812 — Rent arrears
Decided 2 Oct 2024 · Published 2 Oct 2024 · Application 4940812
- Rent arrears
Party names are redacted in the official published order.
Order
- Johanna Ellwood must pay [The landlord/s] $5,498.43 immediately, calculated as shown in table below:
Reasons
- The landlord attended the hearing, conducted via teleconference. The call to the tenant was answered but after my introduction it was ended by the person who answered. I was satisfied adequate service had completed and I continued with the hearing.
- The landlord sought rent arrears and water rates after the tenancy ended. The bond is with the landlord.
- The landlord withdrew the claim for water rates.
- The tenancy ended 13 July 2024. The tenancy was of 13 weeks and two days duration. Two payments were received during this time, totalling $1300.00. That left significant rent arrears as ordered. Filing fee
- Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee. Suppression
- Section 95A RTA states regarding suppression orders that the Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published, unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case.
- The landlord requested suppression in its application. As it has been wholly successful, suppression is ordered.
