[The landlord/s] said that she is not seeking termination, but she wanted some security that the tenants will pay their rent in full and on time in the future. This is understandable given the history of arrears in this tenancy.

The Tribunal can make a conditional termination order. 2

I have made a conditional termination order requiring the tenants to pay the weekly rent of $470.00 by no later of Tuesday each week. The next payment is due by Tuesday 17 September 2024. If the tenants fail to pay the rent, the landlord may terminate the tenancy without having to come back to the Tribunal.

This order shall be in place for a period of two months.

[The landlord/s] mentioned several other tenancy issues, and it is appropriate to note them in this decision: a. [The landlord/s] is seeking access to the premises to have wall insulation put in the property. She has been unable to contact the tenants about this. She will give the tenants notice of when the installers are going to come to the premises and do the work. Landlords must give tenants at least 24 hours’ notice of entering the premises for the purpose of carrying out necessary repairs or maintenance. If a landlord has given proper notice, they do not require the tenant’s consent to enter the premises. b. The tenants have recently parked several cars on the lawn. Parking is available on the concreted areas. The tenants must remove the cars from the lawn. c. [The landlord/s] previously had an issue with the tenants smoking inside. The tenants are not permitted to smoke inside, per the terms of the tenancy agreement. [The landlord/s] noted that the tenants seem to have 1 Section 55(1)(a) Residential Tenancies Act 1986 2 Section 55(1A) RTA stopped smoking inside, but she wanted this point to be reinforced in this decision.

The landlord has been successful in this application, and I must award the landlord the filing fee of $27.00.
