The tenancy of Jared Lamech Whatarau at [Tenancy address suppressed] is confirmed terminated, and possession returned to [The landlord/s], from 8 August 2024 (refer s 50A(2) Residential Tenancies Act 1986).
At that date, rent arrears of $1040.00 was outstanding.
The Bond Centre is to pay the bond of $1,040.00 ([Bond number suppressed]) to [The landlord/s] immediately.

Reasons

The landlord attended the hearing. The number for the tenant was not active.
The landlord had applied for termination for abandonment after the tenant had paid the bond and one week rent but he failed to uplift the key or commence the tenancy.
The tenant had advised that, unfortunately, he had been hospitalised due to an ongoing serious medical issue. No further communication from the tenant was received. The emergency contact details in the tenancy agreement were not able to be contacted.
The landlord later found a social media post that informed the tenant had passed away. RIP.
The landlord has a new tenancy contracted but it is yet to commence.
Per s 50A(2), I have set 7 August 2024 as the end date of this tenancy. That leaves a rent arrears total that is covered exactly by the bond.
Section 95A RTA states regarding suppression orders that the Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published, unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case.
Further, the Tribunal may, on the application of any party to proceedings or on its own initiative, having regard to the interests of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published.
The landlord requested suppression in its application. As it has been wholly successful, suppression is ordered. I considered suppression of the tenant name but I believe it more appropriate to not, given his whānau may benefit in the future from being aware of how this tenancy concluded.
